Passanelli Terms and Conditions - wine webshop

Article 1 – Definitions

Passanelli: the entrepreneur who sells wine remotely to consumers.
Consumer: natural person who is not acting in the course of a profession or business.
Agreement: the purchase agreement concluded via the webshop.
Cooling-off period: the statutory period during which the consumer can exercise the right of withdrawal.
Right of withdrawal: the right of the consumer to terminate the agreement within the cooling-off period.
Durable data carrier: any means by which information can be stored and consulted unchanged.

Article 3 – Applicability

These general terms and conditions apply to every offer made by Passanelli and to every agreement concluded via the webshop.
The terms and conditions will be made available before the agreement is concluded.
Deviations are only valid if agreed in writing.

Article 4 – The offer

All offers are without obligation, unless stated otherwise.
The offer contains a clear description of the wine, including content, alcohol percentage and price.
Obvious errors or mistakes are not binding on Passanelli.
Images are indicative.

Article 5 – Conclusion of the agreement

The agreement is concluded when the consumer accepts the offer and completes the order.
Passanelli will confirm the order electronically.
Passanelli may refuse an order if there are valid reasons for doing so.

Article 6 – Age limit and alcohol legislation

The sale of alcoholic beverages is only permitted to persons aged 18 and over.
Passanelli reserves the right to carry out age checks upon delivery.
If, upon delivery, it appears that the recipient is under the age of 18, the delivery will be refused and the costs will be borne by the consumer.
By placing an order, the consumer declares that they are 18 years of age or older.

Article 7 – Right of withdrawal

The consumer may terminate the agreement relating to the purchase of wine within 7 days without giving reasons.
The cooling-off period commences on the day after receipt of the order.
The consumer exercises the right of withdrawal by means of an unambiguous statement by e-mail or via the model withdrawal form.
After withdrawal, the consumer must return the wine within 7 days.
The consumer is liable for any loss of value if the bottles have been used more than necessary to determine their nature and characteristics.
Opened bottles of wine are not eligible for return.

Article 8 – Costs of withdrawal

The costs of return shipment are borne by the consumer.
Passanelli will refund all payments received, including the standard shipping costs for the initial shipment, within 14 days of withdrawal.
Refunds will be made using the same payment method, unless otherwise agreed.
Passanelli may wait to refund until the return shipment has been received or proof of this has been provided.

Article 9 – Prices

Article 10 – Delivery and risk

Delivery will be made to the address specified by the consumer.
Orders will be delivered within 30 days at the latest, unless otherwise stated.
The risk of damage or loss is transferred to the consumer at the time of delivery.

Article 11 – Conformity and warranty

Passanelli guarantees that the wine delivered complies with the agreement and legal requirements.
If a product is defective or has been delivered incorrectly, the consumer must report this within 5 days of discovery.
The statutory warranty applies.

Article 12 – Payment

Payment must be made in advance using the payment methods offered.
Incorrect payment details must be reported immediately.
In the event of non-payment, Passanelli may charge reasonable costs within legal limits.

Article 13 – Complaints procedure

Complaints must be submitted within 1 month of discovery.
Passanelli will respond to complaints within 14 days.
If no solution is reached, the consumer can contact WebwinkelKeur via www.webwinkelkeur.nl, if Passanelli is affiliated with this organisation.
